Therefore, Axis is not obligated to provide a defense or indemnification to Stewart in connection with the Ward Action, U.S. District Court Judge David Hurd wrote in a decision issued Friday.Stewart attorney Brian Gwitt said he had no comment on the decision and whether there would be an appeal.The decision leaves Stewart to pay all of his attorney fees in defense of claims from the Ward family, as well as any claims determined through a settlement or a trial.Wards parents seek unspecified damages, alleging Stewart could have avoided their son in the accident.The case is pending in U.S. District Court in Utica (Hurd is also the judge in that case) with a discovery deadline of Jan. 6.
